I would bet no charges will be filed. It's very hard to prosecute a gray matter crime without a victim. A victim is unlikely to come forward since it would be confessing to a crime. Add to that the "victim" is probably linked to other cases and it is hard to find a guy willing to testify even if the homeowner was acting outside the law. The derilict probably just went home and cleaned his pants out. Maybe he'll remember the possibility of dodging lead the next time he trys to break into some other persons car.

10mm would be good for killing the brown bear on his lawn also. Do I think the thief deserves what he got yes. Is it legal for somone to go outside his home to protect his car not the way I read the ohio laws. He should have called the police and made himself a good witness of the crime instead of trying to stop the crime with his gun. It is just a car.

I had a situation once where someone was breaking into my garage stole a cd player and about 2k worth of cd's but one night I waited up like all night to see if they'd come back and of course I was waiting with a 12ga but they came back and I caught them in the middle of it,it was some teenage kids and I had a bead on them and didnt pull the trigger because they were kids but when the cops came and there were a lot of cops that came like 8 cars....... I was telling them what happened and that I almost shot them, they told me that if I had I should drag them into the house.... (for real) and I'd be in my rights.... now when they were telling me this the whole time I'm thinking is it really worth someone's life over a cd player.... and how crazy is it of them to tell me that..... they did catch them and I got my stuff back....

Too many variables in this situation, a great prosecutor in a gun hating community, you may get the book thrown at you. Other places with a great defense attorney they may carry you out on their shoulders and name a street after you.

Unless he was IN the car and the person was trying car jack him, no it wasn't a good shoot.

You don't "fire in someone's general direction". You are accountable for every bullet that comes out of the gun.

I have seen these many of times and I think they are very disturbing facts. People refuse to believe that could happen to them and that is the thinking of most victims. :bigthumb
