monday I went into Value city to get a cheap bunkbed and a coupel dressers for the kids. I inquired about 2 mattresses as well. I agreed to purchase 1 bed, 1 bed board ( I have one) 3 6 drawer chests and a twin mattress. The guy tells me they have everything in stock. BEfore I paid he verified it and said it would have to wait til the 17th and tried to convince me to purchase another mattress I had mentioned. THe problem for delivery was the mattress so I had bith of them removed and was assured they would arrive wednesday morning. I paid CASH. I came in on today (thursday) to pick up the items. The manager was back in the pickup area and was in a foul mood. I was trying to get the items by early next week but he was not willing to do anything so I went up front to get a refund. He told me the check would be mailed from the main office and I should have it in 3-4 weeks. By now I wasn't happy. I replied assertively so you are telling me you promise me an item in 2 days and when it isn't here on time and I want my money back to go get the stuff elsewhere that I have to wait 3-4 weeks. 5 people behind me were waiting to complete sales and just straight left. Several others stood and watched for a minute and eventually just left. The manager told me if I wasn't ok with those terms he would call the police. I said fine call the police you are the one stealing from me. So I went out to my truck to get my phone and came in asking for the number to corporate or regional offices. The manager gave me his phone number and answered it in front of me. Then the police showed up. Officer Zimmerman was a seasoned officer, not old but he wasn't a rookie. He handled the situation ok and showed me the receipt that said the terms. I grunted and started walking towards the door. Told him I would take it up with corporate in the morning. I was 10 ft from the door when some fat stupid loudmouthed rookie cop with the desire to inflict his high school sorrows on the world walks in running his mouth. Officer Vently. He hollers to me from about 20 ft. So are you ready to leave like these nice people have been telling you to do. I replied boldly "I was never told to leave". At which point fatso says come here. I replied sarcastically "what are you going to arrest me and stuck my wrists out saying read me my rights"
He spun me around aggressively then cuffed me as tight as pissbile behind my back. Running his big fat trap the entire time yet never reading me my rights. Then throws me in the back seat of the cruiser with the seat back as far as possible for about 45 minutes. I have a herniated disk in my middle back and cannot sit in certain positions well. I started getting muscle spasms. I told him wabout my condition and asked him to let me stand. He refused and they got worse. They wrote me a BS ticket for public nuisance saying I cursed and threatened people. I will see them bastages in court.
Now I need to go to Union Township PD and file a formal complaint and tomorrow I'll deal with corporate value sh*tty.

The moral of the story is screw value city.

nice, I got a very nice loft bed for my daughter on cl and got a foam mattress for @ 99 bucks at ikea. The mattress is only about 3 inches thick and she carried it to the truck herself??? I laid on it and it was fine. Acually pretty cumfy. I took a nap on it.
Maral of that story. In 3 to 4 weeks go to ikea and fu-- value city. lol

Well you did screw up for telling them to go ahead and arrest ya... and unfortunatly which i just found out recently with my recent legal problems is that unless its a felony offense they do NOT have to read you your rights. Unfortunatly when it comes their word vs yours in a case like yours you loose. Now not saying he acted accordingly either but I can assure you he's going to be backed by the other cop and they are both going to say you were buligerant (sp?) and obnoxious, and not cooperative when asked to leave.
ps. if your going to try to file a complaint with the PD, go 3 ranks above said officer, the ones directly above are going to cover his ass. So keep going up the chain, srg, to ltnant, to captain or chief ect

I have two words for you BILL RAPP!!!!!!!!!! He's located right in Amelia next to the elementary school if you don't know who he is he's the badest of the badest in Clermont county and also an ex Marine and JAG officer... very cool. Yea I got into with my brother a little over a month ago and UT came to my dads after I'd body slammed him a few times lol and my brother was living with me at the time they boys asked me what I wanted to do and I said all I want is for him to move out, they went and talked to him and were o.k. well you stay here he promises he'll be out by 6:00 this was at 4:00 and I was like hold the F up you want me to stay here while he moves you've gotta be outta your mind well they assured me everything would be o.k. HA! So I get home to find he's stolen about everything that wasnt too big or was of little or no value..... don't get me wrong I have family members that are Sheriff's but F UT F their little GOD complex I've yet to meet a UT that wasnt the biggest prick ever........ I've had the interior of my car completly tore apart and sent on my way no ticket no nothing just held me on the side of Clough and ripped apart every thing they could, brought the dogs you name it and I've never been in trouble for anything ever! nothing! I havent even had a speeding ticket in like years.... and I wasnt doing anything at the time to get pulled over.... PRICKS!!!!!!! I hope you nail their PB asses....... sorry to steal your rant a little but UT is a touchy subject in my book.......

As for the whole reading you your rights thing. That is only if they are going to question you after you are placed under arrest and use the information you give in court.
Just because you are under arrest does not mean you must be read your rights.

How the hell can a FIVE lane highway, that's STRAIGHT, that use to be 50MPH be dropped to 40 and a CURVY ass TWO lane road, Ie: 132, be 50MPH? :confused:

I am waiting until monday to go see the chief. The situation was completely controlled and I was on my way quietly out the door when the rookie came in running his mouth. I will fight them to the end.

Also I will never buy anything from VC again. I had to contact Corp. but believe me you sweet talk them and you get anything you want they just want you to go away quietly. Dude is a badass. He is a longtime friend of the family. My aunt used to work for him. He is definitly the best of the best.

There are several factors as to why the speed limit is what it is. I do the speed studies for Clermont County and it all depends on the avg. speed the road is driven along with number of accidents in the last 3 years and the ADT(avg. daily traffic). Also the road characteristics. Like number of houses, intersection, businesses etc.....If you are having a problem with one of the County or Township roads in Clermont County I might be able to help and if it's a state road I could point you in the right direction of who you'll need to speak with.

No the difference is if you are arrested they have to read you your rights. If you are detained they do not. I was technically detained. I did spend about 4 hours in the ER at clermont afterwards because of it.

As for the searching your car issues. I highly suggest a pocket constitution. They will send them to you absolutely free you don't even pay postage. Google it I got mine and it has shut several officers up for friends. The next officer that asks me to search my vehcile will get a polite no and a thank you for giving me the opportunity to use my new book. :)

I was arrested and remained in Jail for 3 days and was never read my rights. When I spoke to my lawyer(Ken Zuk) about it he said that they do not have to read you your rights. By the way I did get out of the trouble I was in. It pays to have a good lawyer.:)

The only time you have to be read your Miranda Rights is after you are in custody / detained and before any questioning reguarding the crime you have been accused / arrested for. You still have to answer basic info...name, address, phone, etc... even if you refuse to waive your rights. (Requesting a lawyer.)

as stated unless its a FELONY you nevery have to be read rights... custody, arrest, ect.

It does depend on jurisdiction.
In some jurisdictions, a detention differs at law from an arrest, and police are not required to give the Miranda warning until the person is arrested for a crime. In those situations, a person's statements made to police are generally admissible even though the person was not advised of his or her rights. Similarly, statements made while an arrest is in progress before the Miranda warning was given or completed are also generally admissible.
It appears the best thing to do is just never speak when you deal with a hot headed rookie with gun and badge syndrome.

Just because you are under arrest does not mean they have to read miranda rights. Only if they are going to interrogate the suspect.

As far as being wrong by asking them if they were going to arrest me and saying read me my rights when he said yes. Doesn't sound "wrong" to me. Even the senoir officer told the rookie he really didn't have anything.
I heard him tell him all you can do is write a ticket for public nuisance and hope he just pays the ticket rather than fight it in court.

A little help on this one. Is it wrong to ask, no, is a good idea to ask that's an even bigger NO.
Unless you are immediately put in handcuffs the officer is doing what they can not to arrest you.
If they are set on arresting you they are not going to wait and allow tension to build.

The senoir officer had it handled, the rookie was quick to run his mouth and pull his handcuffs. I was on my way quietly out the door when the rookie started. I had walked completely through the store and was within 15ft of the door. The rookie came in looking to make trouble and he did.

A few months? More like till they get rid of their "holier than thou" attitude and realize it's a job like everyone else.

The cops always win. He ran his mouth while you were on the way out. You talked back so he cuffed you. When you go to court, the judge will def side with the officer. Afterall, the manager did call the police on you for a reason.
When the rookie ran his mouth, if you didnt say anything and just left he still won. He got the last word. :lol:

For what it is worth I did have progress with the complaint process with UT. Value City isn't so easy. You cannot directly reach anyone there you have to leave a message and like the refund they will contact you in 3-4 weeks I guess.
I am calling the store right now but I think they are sending me to the guy I dealt with the first time.......
I stand by my story, screw value city.

My point is DO NOT EVER ask an officer if they are going to arrest you.
Especially in the instance as you put it the rookie was out to run his mouth.
If an officer is going to arrest you they will be the first to let you know, I promise you that.
If you feel you are being wronged the street is not the place to argue (EVER). That is what court is for. On the street the officer, even if he is a "rookie" has the final say. There is no need to show your ass, it will only make you look bad in court.
When it comes to arrest powers there is no difference whether it's your first day or you've been on 30 years. It's all the same level.
If the "rookie" wanted to arrest you it makes no difference what a senior officer or supervisor says. He can arrest you, there are not varying degrees of arrest powers (in this situation)
I am giving suggestions to help you and others out that read this. Take the suggestions if you like.
